Terms of Service

Last updated October 15, 2026

These Terms govern your use of SHIFTCARE (the "Service"), a platform that lets home-care agencies post open shifts and lets credentialed caregivers find, claim, and clock in to those shifts. The Service is provided by SHIFTCARE Homehealthcare, LLC ("SHIFTCARE", "we", "us"). When you use the Service, your agreement is with SHIFTCARE Homehealthcare, LLC.

1. Accepting these Terms

By creating an account or continuing to use the Service, you agree to these Terms. If you use the Service for an agency, you confirm you have authority to bind that agency. You must be at least 18 years old.

2. Accounts

  • Give accurate information, including credentials and licenses, and keep it up to date.
  • Keep your login private. You're responsible for activity under your account.
  • Caregivers must be approved and pass a background check before they can see or claim shifts.

3. Shifts, attendance and location

  • Cancelling a claimed shift less than 1 hour before it starts adds a strike. Three strikes in 90 days pauses shift claiming for 14 days.
  • A no-show places the account on hold until we review it.
  • Clocking in requires location permission and being near the work location. We use this only to verify attendance.
  • Agencies are responsible for patient care decisions, employment relationships, pay, and compliance with labor and healthcare rules. SHIFTCARE is a scheduling tool, not an employer or care provider.

4. Acceptable use

You must not:

  • use the Service for anything unlawful, or to commit fraud or send spam;
  • falsify credentials, attendance, or location;
  • infringe anyone's intellectual property or privacy;
  • interfere with the Service's security, including uploading malware, probing for weaknesses, or scraping;
  • reverse engineer, resell, or redistribute the Service.

5. Payments and subscriptions

Caregivers use SHIFTCARE free. Agency memberships include a 7-day free trial and then cost $49/month until cancelled. Payments are processed securely by our payment partner, Stripe, which may also act as the seller of record for tax purposes on some transactions. You can update your card, view invoices or cancel anytime from Manage billing on your account page. The free trial is available once per agency. See our Refund Policy. If you cancel, you keep access until the end of your paid period.

6. Intellectual property

We own the Service and its software, documentation and branding. We give you a limited, non-exclusive, non-transferable right to use the Service while your account is active. You keep ownership of the content you add and let us host and process it only to run the Service.

7. Availability and warranties

We work hard to keep SHIFTCARE running, but we don't guarantee it will be uninterrupted or error-free. To the fullest extent the law allows, the Service is provided "as is", without implied warranties of merchantability or fitness for a particular purpose.

8. Limitation of liability

To the extent the law allows, we aren't liable for indirect, consequential or special damages, such as lost profits or data. Our total liability is capped at the fees you paid us in the 12 months before the claim. None of this limits liability for fraud, death or personal injury where the law doesn't allow it.

9. Suspension and termination

We may suspend or end access for a material breach of these Terms, non-payment, security or fraud risk, or repeated or serious policy violations. You can close your account at any time. After an account closes, we delete or anonymise its data as described in our Privacy Policy.

10. Changes, law and contact

We may update these Terms and will post the new version here. These Terms are governed by the laws of the State of Ohio, and disputes will be heard in the courts of Ohio. Questions: sarah.newtonapplebooks@gmail.com.
